The human brain is wired to recognize patterns and make generalizations, even those based on faulty or incomplete information. And contrary to popular opinion, lawyers are human as well and therefore, we are just as susceptible to forming biases and acting upon them. And it does not require that we harbor ill will or animus towards other people. In fact, most often, our biases are not even our own, but rather those that have been taught to us.
In this eye-opening presentation, the presenter will use videos to show lawyers just how easy it is to form these biases, how they manifest themselves in the way we treat clients, colleagues and opposing parties, and most importantly, how we can reduce the effect of these biases by recognizing and compensating for them.

Wednesday, April 30, 2025 - MESA CLE - Discipline or No Discipline (Episode 401) A CLE Game Show

In this interactive game modeled after the popular television game show, you will be presented with 30 briefcases. Each briefcase contains the details of an actual disciplinary case that was filed against a U.S. lawyer. When you select a case, you will hear the facts of the case and then, as counsel for the respondent, you will be offered a "deal" (e.g., a reprimand, 1-year suspension, etc.). You will then be asked to accept the proposed discipline or to reject it, in hopes that the actual sanction imposed was less severe than the proposed sanction. If you choose correctly (accepting a good deal or rejecting a bad deal), you will be awarded the points contained in that briefcase.
At the end of the hour, you will see how your score compares to other lawyers across the country.

Due to ransomware attacks, law firms are increasingly becoming the targets of class action lawsuits. They often claim that lawyers did not take the necessary steps to protect their client's data. In many cases, the allegations are supported by the facts. Attorneys are not network security experts and often leave it to their network management company.
This two-hour course will give attorneys an overview of the necessary steps to protect their networks and mitigate exposure to these lawsuits. The instructor, John Lucich, will provide easy-to-understand network security concepts and address any questions.
This seminar will be an informal working lunch. All attendees will receive a free copy of John's book, Pocket Guide for Investigating Ransomware & Network Intrusions, published in 2020.
John Lucich is the founder & CEO of the Network Security Group, which has been designing and managing midsized to large networks nationwide for more than 26 years. Mr. Lucich has been providing consulting services for network assessments, network management, intrusion investigations, network and computer risk mitigation, digital forensics, software development, expert witness testimony and has personally assessed the networks of seven casinos nationally. In 2017 Mr. Lucich and his company investigated a hack into an Edison New Jersey company. Mr. Lucich tracked the intruder back to his office in China and his residence in New York City. Mr. Lucich subsequently met with the FBI and the intruder was later indicted. The victim company was subsequently awarded 7.1 million dollars during a civil trial.
Mr. Lucich is a technologist who is retired from the New Jersey Attorney General’s Office, Organized Crime Racketeering & Corruption Bureau, where he was directly involved in conducting high-tech crime investigations and computer forensics since 1988. Mr. Lucich served five years as an adjunct professor of computer science for Felician College and is a nationally recognized expert, lecturer and author on network security and computer forensics. John taught a cybercrimes course at the Attorney General’s Office academy in Sea Girt, New Jersey for 10 years.

"The Other Fellow May Be Right: The Civility of Howard Baker"
In the current political and cultural environment, civility is going the way of the dinosaur. Our "leaders" now argue for the sake of argument, accuse for the sake of advantage, and seek to demonize those with opposing points of view. Consequently, public governance has become dysfunctional. But there was a time when civility and collegiality and teamwork were cherished American values. There was a time when leaders from opposing political parties were actually friends and tried without compromising their principles to work together in a bipartisan effort to promote the general welfare. One of the greatest exemplars of this civility was a United States Senator from Tennessee. For over forty years, he was a leader in the most contentious arenas in American life: courtrooms, political campaigns, the halls of Congress, and the White House. In all of these venues, he practiced the art of strategic civility that brought adversaries together, finding agreement often to their surprise. The Senator was Howard H. Baker, Jr. of Tennessee, and to this day, he remains a role model of what strategic civility can accomplish. This book is the story of his civil life.
